WELCOME TO FANORY TECHNOLOGY PRIVATE LIMITED (“Fanory”). BY ACCESSING THE Fanory WEB-SITE AND/OR THE APP AND/OR LOGGING IN FOR SERVICES AND/OR SUBSCRIBING FOR Fanory CONTENT, YOU AGREE TO BE BOUND BY THIS PRIVACY POLICY AND THE TERMS & CONDITIONS, WHETHER OR NOT YOU REGISTER AS A USER (“YOU”, “YOUR”, “USER”, “CELEBRITY USER” HEREINAFTER COLLECTIVELY REFERRED TO AS “USER”). ALL INFORMATION COLLECTED BY FANORY STAYS WITH FANORY. ANY COMPANY OR USER/CELEBRITY USER INFORMATION COLLECTED BY FANORY WILL ONLY BE USED TO IMPROVE YOUR FANORY EXPERIENCE. THIS COMMUNITY GUIDELINES AND CONTENT POLICY (“POLICY”) DESCRIBES THE NATURE OF ENTERTAINMENT MADE AVAILABLE AT FANORY.  UNLESS EXPLICITLY STATED OTHERWISE, ANY CURRENT, UPDATED AND NEW ENTERTAINMENT CONTENT, SERVICES AND PRODUCTS SHALL BE SUBJECT TO THIS POLICY, AS WELL AS THE TERMS & CONDITIONS ("TERMS & CONDITIONS'') AND THE PRIVACY POLICY (“PRIVACY POLICY”). IN ADDITION, FANORY RESERVES THE RIGHT TO MODIFY THIS POLICY AT ANY TIME BY POSTING THE UPDATED VERSION HERE AND CHANGING THE VERSION DATE ABOVE. THEREFORE, PLEASE CHECK THIS PAGE FOR UPDATES WHENEVER YOU VISIT ANY FANORY WEBSITE(S) AND/OR APP(S), AND Fanory MAY ALSO ELECT TO NOTIFY ITS REGISTERED USERS/ CELEBRITY USERS OF MATERIAL CHANGES VIA E-MAIL OR OTHER MEANS.

If user and/or celebrity user installs, uses, accesses Fanory WEBSITE(S) AND APP(S) or any of its features, such user and/or celebrity user shall have read and accepted the terms of this Policy together with the Terms & Conditions and Privacy Policy of Fanory. By using Fanory WEBSITE(S) AND APP(S), the user and/or celebrity user enters into binding contract(s) with Fanory. If you as a user/celebrity user do not accept the terms of this Policy together with the Terms & Conditions and Privacy Policy of Fanory you must not use, install, access Fanory WEBSITE(S) AND APP(S) or any of its features

Fanory provides a neutral, intermediary platform that aims to foster and create a diverse and inclusive community and we are not liable for any third-party information, data, content or communication link made available or hosted by us. We do not initiate the transmission or select the receiver of the transmission or select or modify the content/transmission.

In pursuance of this, this Policy is intended to help users/celebrity users understand the nature of content which may be available on Fanory WEBSITE(S) AND APP(S).

User/celebrity user shall be solely responsible for the content posted, shared, modified, uploaded, transmitted, updated and hosted by such user/celebrity user and it is such user’s/celebrity user’s responsibility to ensure that his/her/its content is in line with this Policy as well as the Terms & Conditions and Privacy Policy.

This Policy applies to all users/celebrity users of Fanory and FANORY WEBSITE(S) AND APP(S) in its sole discretion may take any action against content posted by its users/celebrity users that does not comply with this Policy and/or its Terms & Conditions and Privacy Policy.

User/celebrity user agrees that he/she/it shall not host, display, upload, modify, publish, transmit, update or share any information that:

(a) belongs to another person and to which you do not have any right to;

(b) is grossly harmful, harassing, blasphemous defamatory, obscene, pornographic, paedophilic, libellous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever;

(c) harms minors in any way;

(d) infringes any patent, trademark, copyright or other legal, privacy and proprietary rights;

(e) violates any law for the time being in force;

(f) deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;

(g) impersonates another person;

(h) contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource;

(i) threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting any other nation.

CATEGORIES OF OBJECTIONS:

INTELLECTUAL PROPERTY INFRINGEMENT

User/celebrity user is the owner of all of the content that such user/celebrity user creates and posts on Fanory WEBSITE(S) AND APP(S). Such user/celebrity user, shall not post any content that he/she/it is not entitled to share or post. User/celebrity user shall upload only those videos and content that such user/celebrity user has created or that such user/celebrity user has been legally authorised to use. User/celebrity user shall not use any content such as such as music records or portions of videos created by anyone else, in his/her/its posts or other uploads, where intellectual property vested in such content does not vest in the said user/celebrity user.,. User/celebrity user shall not post any content that he/she/it has copied or accessed from any other source including the internet, for which such user/celebrity user has not obtained legal and valid authorisation to post. User/celebrity user shall respect the copyrights, trademarks and other all intellectual property rights including moral rights of other persons. User/celebrity user  video(s) will be taken down without notice to such user/celebrity user if Fanory receives a complaint that such user/celebrity user has infringed someone else’s intellectual property rights.

THREATS, CYBER-BULLYING, HARASSMENT AND HATE SPEECH

User/celebrity user shall never write or post any content or video threatening any person or a group of persons of causing harm to any person or property. This includes threats of physical harm, theft, property damage, reputational damage, defamatory content and threats of financial loss. Such behaviour is strictly prohibited. 

All forms of blackmail, harassment, intimidation, predatory behaviour, stalking, violating the privacy of any person or disclosing the private information of other persons are prohibited. User/celebrity user shall not post any content that promotes, incites or condones violence, hatred or discrimination against any person or groups of persons based on nationality, race, ethnicity, region, religion, caste, disability, deformity, age, sex, gender, sexual orientation, gender identity or political affiliation.

SELF HARM, SUICIDE AND DANGEROUS CONTENT

The welfare and wellbeing of all users of Fanory WEBSITE(S) AND APP(S) is of utmost priority and in furtherance thereto Fanory strives to create a safe environment for its users. Therefore, Fanory shall never allow any content to be posted or circulated that depicts, glorifies, encourages, instructs, or promotes any form of self-harm or self-injury, engagement in dangerous or risky activity that has an imminent risk of physical or mental injury. As an exception any content that provides support, resources, coping mechanisms for those struggling with thoughts of self-harm or suicide are permitted.

VIOLENT AND GRAPHIC CONTENT

User/celebrity user shall not post violent, gruesome or graphic content that is intended to be shocking, sensational, or gratuitous and depicts violent or accidental deaths involving real people. 

SEXUALLY EXPLICIT CONTENT AND SOLICITATION

Nudity or any content that displays any private parts of a person is not permitted on Fanory WEBSITE(S) AND APP(S) and further Fanory strictly prohibits all pornographic and sexual content including digitally created content. Pornographic and sexual content includes content that depicts or is related to sexually explicit language, sexual fetishes, sexual arousal and sexual activity. All content that facilitates, promotes or coordinates sexual encounters between persons and sexually explicit language is prohibited. Further, all content that promotes, glorifies or depicts any form of sexual violence or sexual exploitation or non-consensual sexual acts are prohibited.

SAFETY OF MINORS

Fanory is committed to ensuring that FANORY WEBSITE(S) AND APP(S) are a safe and accessible platform and in pursuance of this, we are deeply committed to ensuring the safety of minors. All and any content, including content that is in a digital format, depicting nude or even partially nude minors or the private parts of minors are strictly prohibited. Any content, including content that is in a digital format, that depicts a minor in a sexual context or in connection with any sexual activity, is strictly prohibited. All content that sexually objectifies minors is prohibited. Any content, including content that is in a digital format, that portrays, promotes or glorifies the sexual exploitation of minors or paedophilia or violence against minors is prohibited. Any and all activity related to grooming of minors for the purposes of engaging in sexual abuse, sexual exploitation, or sexual trafficking of such minors is strictly prohibited. User/celebrity user is prohibited from posting any content that violates the modesty of minors or encourages, incentivizes or blackmails a minor to transmit any content that is sexual in nature. All posts that involve or engage a minor in a sexually explicit conversation are strictly prohibited. All instances or suspected instances of sexual exploitation of minors shall be reported to the authorities.

UNLAWFUL ACTIVITIES, TERRORISM AND ORGANISED CRIME SYNDICATES

User/celebrity user shall not post any content that is unlawful or which is prohibited under any national or local laws. User/celebrity user shall not use Fanory WEBSITE(S) AND APP(S) for any illegal activities or for the conduct of lawful activities in an unlawful manner. All content that promotes, glorifies or incites the commission of any unlawful activities or offences is prohibited. Terrorists are prohibited from using Fanory WEBSITE(S) AND APP(S). Terrorists include non-state actors that use planned and deliberate violence or threats of violence against civilians, in the pursuit of any political, religious, racial, nationalist or ideological objects. All content that promotes, supports or glorifies any terrorists or criminals or criminal and unlawful activities is prohibited.

DRUGS AND NARCOTICS

In order to ensure the safety of users, any user/celebrity user shall not post any content that depicts, promotes, encourages or glorifies the consumption, possession, manufacture or trade of drugs, narcotics and other controlled substances. User/celebrity user shall not sell, offer for sale, trade or solicit any drugs, narcotics or other controlled substances on Fanory WEBSITE(S) AND APP(S). User/celebrity user shall not post images and/or videos that glorify or promote rave parties; or make consumption of drugs, narcotics or other controlled substances fashionable.

SPAM, FRAUDS AND MISLEADING INFORMATION

Fanory is committed to protecting the privacy and sensitive personal information of users. In order to foster a safe and authentic platform for the free expression and exchange of ideas of users, Fanory prohibits all attempts to gather sensitive user information through Fanory WEBSITE(S) AND APP(S) and such attempts constitute an abuse of Fanory platform and services. User/celebrity user shall not use Fanory WEBSITE(S) AND APP(S) to upload, transmit, distribute, store or otherwise make available in any way: files that contain viruses, trojans or other material that is malicious or harmful. User/celebrity user shall not make or accept any payments to or from any user on Fanory WEBSITE(S) AND APP(S). User/celebrity user shall not post any content that promotes any scam or fraud including phishing, ponzi schemes, betting and lotteries. User/celebrity user shall not engage in spamming, artificially increasing or collecting likes, shares, comments or followers. User/celebrity user shall not repeatedly message or contact users without their consent. Making or accepting payments whether in money or otherwise in exchange for views, likes, shares, comments or followers is strictly prohibited. User/celebrity user shall not operate multiple Fanory WEBSITE(S) AND APP(S) accounts under false pretences, to fabricate fake activity or circulate commercial spam.

While User/celebrity user need not use his/her/its real name on Fanory WEBSITE(S) AND APP(S) as his/her/its username, such user/celebrity user is required to provide Fanory with accurate and up to date information at the time of registering with Fanory WEBSITE(S) AND APP(S) to authenticate such user/celebrity user. Any misinformation that could that is harmful to the community at large is prohibited by Fanory and user/celebrity user must not post any misinformation that:

• is defamatory in nature;

• may incite fear, hate or prejudice against a person or a group of persons;

• pertains to medical treatments, health conditions or health of individuals;

• is related to any scams, frauds hoaxes or phishing attempts; and

• pertains to local or national elections or other such processes.

IMPERSONATION

User/celebrity user shall not impersonate another person or organisation and shall not post any content on Fanory WEBSITE(S) AND APP(S) by using someone else’s name, details, images, logos, trademarks, tradenames or brand names. User/celebrity user shall not, at any point, create any accounts for the purpose of misleading others. However, parody accounts, fan accounts and other accounts that do not mislead other users of Fanory WEBSITE(S) AND APP(S) are permitted.

 

 

PRIVACY AND PERSONAL INFORMATION

User/celebrity user shall not post or threaten to post any content revealing any personally identifiable information of any person including but not limited to a person’s mobile number, landline, e-mail address, residential address, place of work or employment, bank details, social security number, Aadhar number, PAN Number, or passport number. Further, user/celebrity user shall not post and do not threaten to post any videos or images of any person without such person’s consent.

THREATS TO FANORY WEBSITE(S) AND APP(S) SECURITY

All activity and content that undermines the security of Fanory WEBSITES AND APPS is prohibited. User/celebrity user is prohibited from circulating or distributing any files on Fanory WEBSITE(S) AND APP(S) that contain viruses, trojans, malware, ransomware or other materials that are malicious or harmful. User/celebrity user shall not attempt to hack the Fanory website(s), application(s), software, server(s) or associated networks or circumvent its measures to restrict user access.

User/celebrity user shall not attempt to make unauthorised copies, modify, adapt, translate, reverse engineer, disassemble, decompile or create any derivative works of the services or any content included therein, including any files, tables or documentation (or any portion thereof) or determine or attempt to determine any source code, algorithms, methods or techniques embodied by the services.

TAKEDOWN:

FANORY has an efficient Grievance Redressal Team to ensure a secure entertainment experience for its user/celebrity user. The Grievance Redressal Mechanism is set out in detail under the Terms & Conditions and Privacy Policy. Alternatively, the user/celebrity user or complainant may click on the REPORT Tab situated at the top right corner of the content; select appropriate report type and category of objection; add comment setting out details of issue with the content; and click the SUBMIT button. Any user/celebrity user who is aggrieved by the content published on the Fanory WEBSITE(S) AND APP(S) may lodge a complaint against such content. Grievance Redressal Team at Fanory shall request such user/celebrity user or complainant to provide requisite documentary evidence to understand locus and validity of complaint and the complainant. In the event, Fanory requests additional details/information from the user/complainant, the same must be provided by the user/complainant to Fanory within 36 hours of such request being made by Fanory, failing which the grievance will be deemed dismissed. The prescribed timeline of 15 days for redressal of grievance will commence from the date of receipt of complete details/information on the correct email ID and in the prescribed format. Fanory shall send clear e-mail correspondence regarding the commencement of 15 days of grievance redressal time-line upon receipt of all necessary information from the user/complainant. If any user/celebrity user violates this Policy by posting, sharing objectionable content or indulging in objectionable activities as specifically set out in this Policy, Fanory in its sole discretion reserves the right to takedown such objectionable content with immediate effect and initiate any suitable action against such user/celebrity user.  Such action may include the immediate removal of the offensive/objectionable content from Fanory WEBSITE(S) AND APP(S) , termination of such violating user’s/celebrity user’s Fanory WEBSITE(S) AND APP(S) account, deactivation of such user’s/celebrity user’s Fanory WEBSITE(S) AND APP(S) account, and/or sending notification/report of such offensive/objectionable content or activity to the concerned authorities. Fanory is not involved in authoring or publishing any content on its WEBSITE(S) AND APP(S), it is not obligated to pay any damages or costs to any aggrieved party for any content or part thereof violating their rights. Being an intermediary, Fanory is not required to monitor the content on its WEBSITE(S) AND APP(S). Fanory is only required to take action against any content/advertisement only when it receives an order from the appropriate authority or a complete complaint establishing a prima facie case. However, Fanory has for the safety of its users created Grievance Redressal Team and Fanory as a socially aware entity reserves the right to takedown any content if it determines, in its sole discretion, that such content violates any law or its Policies and Terms & Conditions of its WEBSITE(S) AND APP(S). Fanory shall initiate strict legal action against user/celebrity user who lodge false or frivolous complaints. Fanory retains all its rights to safeguard the integrity of its WEBSITE(S) AND APP(S). 

Fanory may modify this Policy, its Terms & Conditions and Privacy Policy from time to time. If any user/celebrity user objects to or disagrees with any changes, such user/celebrity user may close his/her/its account or terminate his/her/its use of the Fanory WEBSITE(S) AND APP(S). User’s/celebrity user’s continued use of the Fanory WEBSITE(S) AND APP(S)after update/amendment of this Policy, its Terms & Conditions and Privacy Policy shall mean that such user/celebrity user is consenting to the updated terms.
